The following are the terms and conditions for the sale of products from Power Sources Unlimited, Inc. (PSUI)

PSUI accepts orders from the United States, its territories and Canada. Sales generated outside of this territory require a specialized written quotation from a PSUI Account Manager and a confirming written purchase order from customer. A brief listing of order requirements is as follows:
- International orders require prepaid wire transfer prior to ordering product, with a minimum of $1,000 USD
- A wire transfer fee of $100 will be added to customers Pro Forma invoice
- Orders are NCNR(non-cancelable, non-returnable)
- Individualized quotation from PSUI to be issued defining order requirements, lead time, value etc.
- Freight carrier is the responsibility of the Buyer
- PSUI reserves the right to deny shipment to certain countries
PSUI accepts the following: MasterCard, VISA, American Express, American Express Corporate Purchasing, Discover, and C.O.D. We also extend credit to qualified institutions and companies.
Please call 1-800-966-PSUI (7784) to obtain a credit application. When opening an account with us, please allow sufficient time to complete the approval process. You may want to include a check or authorization for C.O.D. to avoid delay in your initial order.
Dishonored Check Policy:
If your check is dishonored for any reason by the bank or other institution on which it is drawn, you agree to remit $50.00 as a service charge. In addition, you agree to remit any other reasonable charges imposed by any check verification company or collection agency that we may use for collection.
Pricing and Quantities:
Prices are subject to change without notice and quantities may be limited.
Massachusetts residents will be charged 6.25% sales tax. PSUI does not remit sales tax to states other than Massachusetts. If you have a Massachusetts resale or exempt certificate, please submit it along with your order.
Delivery and Order Shipment:
PSUI will use its reasonable efforts to meet Customer delivery requirements. PSUI will not be liable for any costs or expenses as a result of a delay in delivery. Orders are shipped Monday thru Friday and will ship UPS Ground unless another method is specified. All prices quoted and shipped are F.O.B. Wrentham, MA unless otherwise specified. Shipping charges are the responsibility of the Customer and will be included on our invoice unless otherwise specified. Any disputed shipping charges billed to a Customer account or consignee billing, will be charged back to the Customer by PSUI. Our freight carriers will assess an additional fee for duty/taxes on all product shipped outside the U.S. These fees are the responsibility of the customer.
Loss or damage in Transit:
Claims for loss or damage in transit are the responsibility of the buyer. If you require our assistance, PSUI will assist in securing any adjustment up to the limits of the carrier. All orders will be shipped without extra insurance unless specified by the buyer.
Any order for standard product that is scheduled to ship within sixty (60) days cannot be rescheduled. Any order for modified-standard product that is scheduled to ship within ninety (90) days cannot be rescheduled. Any order for custom product that is scheduled to ship within one hundred and twenty (120) days cannot be rescheduled. An order may be rescheduled one time from the original scheduled ship date, but for no more than sixty days from the original ship date. For blanket purchases orders, rescheduling applies to each date designated on the purchase order unless other arrangements are made at time of order placement. Any shipment date which is rescheduled may not be subsequently canceled. Please contact PSUI Sales for a complete list of Blanket Order Terms & Conditions.
All customer orders for products not in stock at PSUI at time of order placement are subject to NCNR conditions. All other cancellation requests must be made in writing and approved in writing at the discretion of PSUI.
PSUI keeps our customers aware of new product information via email newsletters. Your contact information has been added to our mailing list. An option is clearly provided to unsubscribe from our mailings at any time. Our mailing list is never shared with or sold to any other organization.
Warranty & Liability:
Under no circumstances does PSUI represent that a specific product will work in a customer’s application. It is the sole responsibility of each customer to thoroughly test each product and part number under their unique parameters and environments to ensure a product will work properly and reliably.
All defects of material or incorrect shipments shall be immediately relayed to PSUI. Any incorrect shipments, i.e. shipping the incorrect part number to customer, will have no liability to Power Sources Unlimited. It is the sole responsibility of the customer to verify and test that part(s) received are the correct parts ordered by the customer.
PSUI is a distributor and in the case of a parts defect will reflect the warranty of the individual manufacturer. The warranty period shall be defined for each manufacturer and their part number separately as requested and required. Defective merchandise must be returned directly to the manufacturer. Please contact PSUI to obtain an RMA (Return Material Authorization) number and the appropriate return address information. Returns are not accepted without RMA numbers. Return freight charges to the manufacturer’s facility must be prepaid by the Customer. Any charges for evaluation or repair are at the manufacturer’s discretion and will be the responsibility of the Customer. Under all conditions the liability shall be limited to the repair or, at the manufacturer’s sole discretion, substitution of goods which prove to be defective.
In any event, there shall be no further remedies or claims against PSUI and its manufacturers. In particular, the customer has no right to rescind a contract, ask for reduction of price or any compensation, such as compensation for any special, actual, consequential, incidental or indirect damages, or any loss of profit, revenue or data based upon non-performance or breach of any of its obligations, whether based in contract, tort, or otherwise.
PSUI will not be liable for the consequential special, incidental or exemplary damages, including, but not limited to loss of profits, cost of any substitute product purchased by Customer’s Buyer, claims of third parties or injury to person or property. Further, PSUI and its manufacturers shall not be liable for damages resulting from improper use, incorrect implementation, or shipments of incorrect part numbers to the customer or third parties. Particularly, the misuse where product specifications, operating instructions or specifications set forth by the manufacturer are exceeded or violated by the customer or third parties.
The warranty shall immediately terminate if the customer or a third party change or try to repair a product without the prior written consent of the manufacturer. The customer agrees to be fully liable for damages resulting from its own instructions for product usage. The customer shall indemnify and hold harmless Power Sources and its manufacturers from any and all loss, liability, damage, cost or expense to the extent arising out of any claims or suits brought by third parties against the customer by reason of any breach of customer covenants or obligations contained in this warranty or any other agreement between the parties.
DO NOT USE PRODUCTS SOLD BY POWER SOURCES AS CRITICAL COMPONENTS IN LIFE SUPPORT DEVICES OR SYSTEMS!
Products sold by Power Sources are not authorized for use as critical components in life support devices or systems. A critical component is any component of a life support device or system whose failure to perform can be reasonably expected to cause the failure of the life support device or system, or to affect its safety or effectiveness.

Product Returned for Credit: Requests for a stock return for credit will be based upon product history/usage and the manufacturer’s policy. Under special circumstances, if a return request is approved, the return will require an RMA number to be issued, a restocking fee, and an offsetting new product order. The customer is responsible for payment of any freight and handling charges associated with the prior shipment of the returned order, as well as payment of shipping charges associated with the authorized product return.
